All sales are subject to acceptance by Betsu Studio (Betsu, LLC) 

GENERAL

This website is owned wholly by Betsu Studio (Betsu, LLC)  Throughout the site, the terms ‘we’, ‘us’ and ‘our’ refer to Betsu Studio.  Please read the below terms that are used to govern our site. If you do not agree with the terms, do not use this site in any way. Additionally, Betsu Studio  reserves the right to modify these terms at any time without prior notification. Site users must agree up and abide by these changes accordingly. For most up to date terms and conditions, please review this section of our website frequently.

All content on this website including photos are the property of Betsu Studio. The contents of this website is intended for non-commercial use by the users or our site.

ENTIRE AGREEMENT

Acceptance of sales is based on the express condition that Buyer agrees to all of the terms and conditions contained herein and also in the material and price lists provided to Buyer relation to our products. These terms and conditions represent the complete agreement of the parties, and no terms or conditions in any way adding to, modifying or otherwise changing the provisions stated herein shall be binding upon Betsu Studio unless made in writing and signed and approved by an authorized representative of Betsu Studio. No modification of any of these terms will be affected by Betsu Studio's shipment of goods following receipt of Buyer’s purchase order, shipping request or similar forms containing printed terms and conditions conflicting or inconsistent with the terms herein.

PRICES AND TERMS

Orders for all products require payment in full. All accounts shall be paid upon receipt when invoiced. Orders must be paid in full, including STORAGE, taxes, freight, shipping charges and service charges prior to shipping. Checks are to be made out to Betsu Studio. Credit cards accepted are American Express, MasterCard, Discover & Visa may be subject to a credit card fee of 3.5%.

TAXES

All taxes of any nature whatsoever now or hereafter levied by governmental authority, whether federal, state or local, both directly or indirectly, upon the sale or transportation of any goods covered hereby shall be paid and borne by Buyer if a resale tax certificate is NOT provided. A Pennsylvania sales tax resale certificate form will be provided and must be filled out and returned to process any sale of Betsu Studio  . 

SEVERABILITY

In the event that any one or more of these terms or conditions is held invalid, illegal or unenforceable, such provision or provisions shall be severed and the remaining terms and conditions shall remain binding and effective.

PRODUCTS

The products featured on www.betsustudio.com.com have been represented to the best of our ability through photography, dimensions and any other descriptions that have been provided. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right but are not obligated to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

FURNITURE DELIVERY / PICKUP

You may choose to have an Item delivered or you may choose to come pick up an Item at our warehouse on a set appointment date. If you choose to have an Item delivered, Betsu shall hire a third party carrier service to deliver an Item purchased pursuant to this Agreement to the delivery location specified in your order receipt.

1. Delivery fees will be estimated at checkout but are subject to change depending on the delivery prices charged by third-party carriers. You will be asked to accept delivery prices higher than those shown at checkout before they are incurred and, if you do not accept an increased delivery price, Betsu may void the contract and cancel the order.
2. It is your responsibility to provide Betsu with all material information relevant to the delivery or pickup of an Item.
3. If a scheduled delivery or pickup is not completed because of something you do or fail to do, you will still be charged all Delivery and/or Restocking Fees per item. For example, if a third party carrier is unable to deliver an Item because you did not accurately describe the delivery location or include all necessary delivery details when arranging for the delivery of an Item (such as failing to indicate that there is no elevator in the building when the delivery is to an upper floor), Betsu would have the right to charge the Customer all item-based Delivery and/or Restocking Fees.

USER SUBMISSIONS

Betsu Studio enjoys an interactive environment through our Social Media. User comments on our social media pages maintained by Betsu Studio will become the property of Betsu Studio. If an image or comment is posted through any social media website, including any image accompanied by a hashtag, referencing Betsu Studio, you are hereby granting access to Betsu Studio a worldwide, royalty-free, fully paid, non-exclusive, perpetual, irrevocable, transferable and fully license without additional consideration to you or any third party, to store, reproduce, distribute, perform, and display (publicly or otherwise), create derivative works of, adapt, modify and otherwise use and exploit such photos, in any format or media now known or hereafter developed, in connection with Betsu Studio’s business.

ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

INDEMNITY

By using this site, you agree to indemnify and hold Betsu Studio (and it’s employees, partners and owners) harmless of any claim or demand, as well as losses, expenses, damages and costs, resulting from any violation of these terms of service of any activity related to your account (including negligent or wrongful conduct).

Betsu Studio cannot be assumed as liable to you, the customer, for any direct, indirect, incidental, special, consequential or exemplary damages that result from the use of, or the inability to use, the materials and services on this site or the performance of any of its products.

 
DISCLAIMERS AND LIMITATION OF LIABILITY

Betsu Studio is providing each item that you purchase on an "as-is" basis". You expressly agree that your purchase of an item is at your sole risk. Betsu disclaims all representations or warranties of any kind to the extent that they may be excluded by law, including, but not limited to, warranties of merchantability and fitness for a particular purpose. Betsu does not warrant that an item will function in an uninterrupted, defect-free or error-free manner or that any such defects or errors will be corrected. Betsu assumes no responsibility for an makes no warranty or representation as to the accuracy completeness, reliability, currentness, usefulness, or decency of any description of any item. Betsu does not warrant that an item will meet your requirements or expectations. You assume total responsibility and risk for your purchase of, access to and use of an item. Except for liability arising from Betsu's gross negligence or willful misconduct, in no event shall Betsu or its officers or employees be liable, whether in contract, tort (including without limitation negligence) or otherwise for any indirect, special, incidental, punitive, exemplary, or consequential damages, including but not limited to, loss of data or other intagibles, income or profit, loss of or damage to property or claims of third parties, even if Betsu has been advised of the possibility of such damages, arising out of or resulting from (1) the quality of an item, including the presence of any damage or defects, (2) the use of or inability to use an item or any service that Betsu may provide in connection with an item or otherwise; (3) any transaction conducted through or facilitated by the site; (4) any claim attributable to errors, omissions, or other inaccuracies in the site or (5) any other matter relating to an item or service that Betsu may offer in connect with an item, any transaction with you or otherwise. In the event that damages are finally awarded in connection with this agreement by a court of competent jurisdiction, except for liability arising from Betsu's gross negligence or willful misconduct, the maximum aggregate liability of Betsu for all damages, losses and causes of action, whether in contract, tort (includig without limitation negligence) or otherwise will be the total amount, if any, paid by you to Betsu for the item in relation to which such liability arose.
